Gender Pay Reporting Suspended

Employers with over 250 employees are required to publish statutory calculations each year, by 30 March for Public Sector and 4 April for Private and Voluntary Sectors, showing how large the pay gap is between their male and female employees.

In a statement today, the Government Equalities Office (GEO) said it has suspended enforcement of the gender pay gap deadlines this year in the wake of the challenge presented to employers by Coronavirus. ​This means they will not investigate any employers failing to report their pay gap. (more…)

Job Retention Scheme and SSP Reclaim

Current information regarding the Coronavirus Job Retention Scheme and SSP Reclaim is as follows:

SSP – Businesses with less than 250 employees, will be entitled to reclaim SSP from day one, up to day 14 for employees self isolating or with coronavirus symptoms.  Directors of Limited Businesses can also reclaim. SSP.- Currently HMRC are yet to confirm how this will be reclaimed.

PAYE payments – HMRC Update and dedicated helpline for companies that have issues with making PAYE payments.

IR35 Off-Payroll Working Legislation

The IR35 off-payroll working legislation, which was due to be rolled out to the private sector from 6 April 2020, has been delayed by one year in light of the recent Covid-19 outbreak.

HMRC confirmed: ‘This is a deferral, not a cancellation. The government remains committed to introducing this policy to ensure that people working like employees, but through their own limited company, pay broadly the same tax as individuals who are employed directly.’ (more…)

IR35 Delay

The government has announced a one year delay to the introduction of the IR35 off payroll working legislation to the private sector in light of the recent Covid-19 outbreak.  The legislation will now come into force in April 2021, which gives medium/large clients and contractors a further year to plan for the changes. Parental Bereavement Leave and Pay Regulations – 6 April 2020

Under the Employment Rights Act 1996 employees currently have the legal right to ‘reasonable’ time off to deal with emergencies, such as the death of a child, and does not allow for prolonged grieving periods.  Until recently, there has been no legal obligation for employers to provide paid time off for grieving parents. Statutory Sick Pay

Statutory Sick Pay (SSP) is payable for up to 28 weeks, at a rate of £94.25 per week.  It is paid for the days an employee normally works (called ‘qualifying days’) and is paid in the same way as normal wages, on the same paydate, with applicable tax and national insurance deductions.

Some companies may offer a company sick pay scheme where enhanced amounts are paid (such as full pay) but a scheme can not pay less than SSP.
