Following the Prime Minister’s announcements yesterday, detailed guidance notes have been published.

Some of the changes are guidance only, others will be law. At the start of the outbreak many of the rules were framed as guidance only, with the police having problems due to the rules being unenforceable. Recently changes have been backed by law.

The government already has the overall legislative framework in place to allow legally enforceable changes to be made without Parliament’s approval (the Coronavirus Act 2020), so legal changes are made by Direction (furlough scheme) or by Statutory Instrument (other changes). The law has yet to be put in place for most of the changes yesterday: when this is done it is likely that they will appear as part of the following revised Health Protection Regulations 2020 Statutory Instrument, the most recent version can be found here: www.legislation.gov.uk/uksi/2020/684
